The Dean of the University of California at Irvine Law School, Erwin Chemerinsky, has written an opinion piece for the Los Angeles Times decrying the potential for partisanship in the upcoming Supreme Court ruling on Obamacare.
By complaining about the partisanship, Dean Chemerinsky exposes his own partisan views on the matter. I would expect a more thoughtful analysis from the head of a major institution.
Since we are going down the partisan road, let me say that the views of Supreme Court justices are ideological not partisan. It is the politics of ideology that are partisan. Conservatives believe in the principles of limited government that is restrained by the Constitution. Liberals believe in the living Constitution that must reflect the times we are living in. These arguments of ideology are adopted by their respective parties. That is where you will find partisanship. Not on the Supreme Court.
